    This statement describes how PC Electric Gesellschaft.m.b.H. processes your data in connection with this website.

  1. Basic information on data processing and legal basis
    1. This data protection statement informs you about the type, scope and purpose of the processing of personal data within our online offer and the websites, functions and content connected to it (hereinafter jointly referred to as "online offer" or "website"). The data protection statement applies regardless of the domains, systems, platforms and devices (e.g. desktop or mobile) used on which the online offer is executed.
    2. The terms used, such as "personal data" or their "processing" we refer to the definitions in Art. 4 of the General Data Protection Regulation (GDPR).
    3. The personal data of users that we process within the scope of this online offer includes inventory data (e.g., names and addresses of customers), contract data (e.g., services used, names of clerks, payment information), usage data (e.g., the web pages visited on our online offer, interest in our products) and content data (e.g., entries in the contact form).
    4. The term "user" includes all categories of persons affected by data processing. They include our business partners, customers, interested parties and other visitors to our online offering. The terms used, such as "user", are to be understood as gender-neutral.
    5. We process users' personal data only in compliance with the relevant data protection provisions. This means that the users' data is only processed if a legal permission exists. I.e., in particular if the data processing is necessary for the provision of our contractual services (e.g. processing of orders) as well as online services, or is required by law, a consent of the user is available, as well as due to our legitimate interests (i.e. interest in the analysis, optimization and economic operation and security of our online offer within the meaning of Art. 6 para. 1 lit. f. DSGVO, in particular in the case of range measurement, creation of profiles for advertising and marketing purposes as well as collection of access data and use of third-party services.
    6. We would like to point out that the legal basis for the consents is Art. 6 para. 1 lit. a. and Art. 7 DSGVO, the legal basis for the processing for the fulfillment of our services and implementation of contractual measures is Art. 6 para. 1 lit. b. DSGVO, the legal basis for processing to fulfill our legal obligations Art. 6 para. 1 lit. c. DSGVO, and the legal basis for processing to protect our legitimate interests Art. 6 para. 1 lit. f.   1. Security measures
    1. We take organizational, contractual and technical security measures in accordance with the state of the art to ensure that the provisions of the Data Protection Act (DSG) are complied with and thus to protect the data processed by us against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons.

  1. Disclosure of data to third parties and third-party providers
    1. Data is only passed on to third parties within the framework of legal requirements. We only pass on users' data to third parties if this is necessary, for example, on the basis of Art. 6 Para. 1 lit. b) DSGVO for contractual purposes or on the basis of legitimate interests pursuant to Art. 6 Para. 1 lit. f. DSGVO in the economic and effective operation of our business.
    2. Where we use subcontractors to provide our services, we take appropriate legal precautions and corresponding technical and organizational measures to ensure the protection of personal data in accordance with the relevant legal requirements.
    3. If content, tools or other means from other providers (hereinafter collectively referred to as "third party providers") are used within the scope of this data protection declaration and their named registered office is located in a third country, it is to be assumed that a data transfer takes place to the third party providers' countries of domicile. Third countries are countries in which the GDPR is not directly applicable law, i.e. basically countries outside the EU or the European Economic Area. The transfer of data to third countries takes place either if there is an adequate level of data protection, user consent or otherwise legal permission.
  1. Provision of contractual services
    1. We process inventory data (e.g., names and addresses as well as contact data of users), contract data (e.g., services used, names of contact persons, payment information) for the purpose of fulfilling our contractual obligations and services pursuant to Art. 6 para. 1 lit b. DSGVO.
    2. We process usage data (e.g., the web pages visited on our website, interest in our products) and content data (e.g., entries in the contact form,..) for advertising purposes, e.g., to display product information to users based on the services they have used to date.
  1. Contact
    1. When contacting us (via contact form or e-mail), the user's details are processed for the purpose of handling the contact request and its processing pursuant to Art. 6 (1) lit. b) DSGVO.
  1. Collection of access data and log files
    1. We collect on the basis of our legitimate interests within the meaning of Art. 6 para. 1 lit. f. DSGVO, we collect data about each access to the server on which this service is located (so-called server log files). The access data includes the name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider.
    2. Log file information is stored for security reasons (e.g. to clarify acts of abuse or fraud) for a maximum of 14 days and then deleted. Data whose further storage is required for evidentiary purposes is exempt from deletion until final clarification of the respective incident.
  1. Cookies and reach measurement
    1. Cookies are pieces of information that are transmitted from our web server or third-party web servers to users' web browsers, where they are stored for later retrieval. Cookies may be small files or other types of information storage.
    2. We use "session cookies", which are only stored for the duration of the current visit to our online presence (e.g. to enable the storage of your notepad,... To thus enable the use of our online presence at all). In a session cookie, a randomly generated unique identification number is stored, a so-called session ID. In addition, a cookie contains information about its origin and the storage period. These cookies cannot store any other data. Session cookies are deleted when you have finished using our online offer and log out or close the browser, for example.
    3. Users are informed about the use of cookies in the context of pseudonymous reach measurement as part of this data protection statement.
    4. If users do not want cookies to be stored on their computer, they are asked to disable the corresponding option in the system settings of their browser. Stored cookies can be deleted in the system settings of the browser. The exclusion of cookies can lead to functional restrictions of this online offer.

      If you have given your consent, this website uses Google Analytics 4, a web analytics service provided by Google LLC. The responsible party for users in the EU/EEA and Switzerland is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google").

    2. Scope of processing
      Google Analytics uses cookies that enable an analysis of your use of our websites. The information collected by means of the cookies about your use of this website is generally transferred to a Google server in the USA and stored there.

      Google Analytics 4 has IP address anonymization enabled by default. Due to IP anonymization, your IP address will be shortened by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. According to Google, the IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

      During your website visit, your user behavior is recorded in the form of "events". Events can be:

    3. Purposes of processing
      On behalf of the operator of this website, Google will use this information to evaluate your [pseudonymous use of the website and to compile reports on website activity. The reports provided by Google Analytics serve to analyse the performance of our website .

    4. Recipients
      Recipients of the data are/may be:

      • Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (as processor under Art. 28 DSGVO).

      It cannot be ruled out that US authorities may access the data stored by Google.

    5. Third country transfer
      Insofar as data is processed outside the EU/EEA and there is no level of data protection corresponding to the European standard, we have concluded EU standard contractual clauses with the service provider to establish an appropriate level of data protection. The parent company of Google Ireland, Google LLC, is based in California, USA. A transfer of data to the USA and access by US authorities to the data stored by Google cannot be ruled out. The USA is currently considered a third country from a data protection perspective. You do not have the same rights there as within the EU/EEA. You may not be entitled to any legal remedies against access by authorities.

    6. Duration of storage
      The data sent by us and linked to cookies are automatically deleted after 14 months. The deletion of data whose retention period has been reached occurs automatically once a month.

    7. Legal basis
      The legal basis for this data processing is your consent pursuant to Art.6 para.1 p.1 lit. a GDPR.

    8. Revocation
      You can revoke your consent at any time with effect for the future by accessing the cookie settings (Go to the home page and at the very bottom you will find the Cookie Settings tab). and changing your selection there. The lawfulness of the processing carried out on the basis of the consent until the revocation remains unaffected.

      You can also prevent the storage of cookies from the outset by setting your browser software accordingly. However, if you configure your browser to reject all cookies, this may result in a restriction of functionalities on this and other websites. In addition, you can prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google, by

  2. Google-Re-/Marketing-Services
    1. The legal basis for the processing of personal data using marketing and remarketing services (in short "Google marketing services") of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, ("Google") for analysis and advertising purposes, is the legitimate interest according to 6 para. 1 lit. a DSGVO.
    2. Google is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law   (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).
    3. Google's marketing services allow us to display advertisements for and on our website in a more targeted manner in order to present users only with ads that potentially match their interests. If, for example, a user is shown ads for products he or she was interested in on other websites, this is referred to as "remarketing". For these purposes, when our website and other websites on which Google marketing services are active are called up, a code is executed directly by Google and so-called (re)marketing tags (invisible graphics or code, also known as "web beacons") are integrated into the website. With their help, an individual cookie, i.e. a small file, is stored on the user's device (comparable technologies can also be used instead of cookies). The cookies can be set by various domains, including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com or googleadservices.com. The IP address will not be merged with data of the user within other offers of Google. The aforementioned information may also be linked on the part of Google with such information from other sources. If the user subsequently visits other websites, he can be shown ads tailored to his interests.
    4. User data is processed pseudonymously as part of Google's marketing services. I.e. Google does not store and process e.g. the name or email address of the users, but processes the relevant data cookie-related within pseudonymous user profiles. I.e. from Google's perspective, the ads are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who this cookie holder is. This does not apply if a user has expressly allowed Google to process the data without this pseudonymization. The information collected by Google marketing services about users is transmitted to Google and stored on Google's servers in the USA.
    5. The Google marketing services we use include the online advertising program "Google AdWords". In the case of Google AdWords, each AdWords customer receives a different "conversion cookie". Cookies can therefore not be tracked across the websites of AdWords customers. The information obtained using the cookie is used to create conversion statistics for AdWords customers who have opted in to conversion tracking. The AdWords customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.
    6. We can also use the "Google Optimizer" service. Google Optimizer allows us to track the effects of various changes to a website (e.g. changes to the input fields, design, etc.) as part of so-called "A/B testing". Cookies are placed on users' devices for these testing purposes. Only pseudonymous user data is processed in the process.
    7. Furthermore, we may use the "Google Tag Manager" to integrate and manage Google analytics and marketing services on our website.

14.1. Facebook SP

    1. We use social plugins ("plugins") of the social network facebook.com on the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 (1) lit. f. DSGVO) social plugins ("plugins") of the social network facebook.com, which is operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"). The plugins can display interaction elements or content (e.g. videos, graphics or text contributions) and are recognizable by one of the Facebook logos (white "f" on blue tile, the terms "Like", "Like" or a "thumbs up" sign) or are marked with the addition "Facebook Social Plugin".     2. Facebook is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).
    3. When a user calls up a function of this online offering that contains such a plugin, his or her device establishes a direct connection with the Facebook servers. The content of the plugin is transmitted by Facebook directly to the user's device and integrated into the online offer by the latter. In the process, usage profiles of the users can be created from the processed data. We therefore have no influence on the scope of the data that Facebook collects with the help of this plugin and therefore inform the users according to our level of knowledge.
    4. By integrating the plugins, Facebook receives the information that a user has accessed the corresponding page of the online offer. If the user is logged into Facebook, Facebook can assign the visit to his Facebook account. If users interact with the plugins, for example by clicking the Like button or posting a comment, the corresponding information is transmitted from your device directly to Facebook and stored there. If a user is not a member of Facebook, there is still the possibility that Facebook will learn and store his or her IP address. According to Facebook, only an anonymized IP address is stored in Germany.
    5. The purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as the related rights and settings options for protecting the privacy of users, can be found in the privacy policy of Facebook: https://www.facebook.com/about/privacy/.
    6. If a user is a Facebook member and does not want Facebook to collect data about him/her via this online offer and link it to his/her membership data stored with Facebook, he/she must log out of Facebook and delete his/her cookies before using our online offer.     1. Our website uses functions of the XING network. The provider is XING AG, Dammtorstraße 29-32, 20354 Hamburg, Germany.
    2. Each time one of our pages containing XING functions is called up, a connection to XING servers is established. As far as we are aware, no personal data is stored in the process. In particular, no IP addresses are stored or usage behavior evaluated
    3. The use of the XING plugin is based on Art. 6 (1) lit. f DSGVO. The website operator has a legitimate interest in ensuring the greatest possible visibility in social media.

    1. You have the possibility to subscribe to a newsletter via the website of PC Electric Gesellschaft.m.b.H.. For this we need your e-mail address and your declaration that you agree to receive the newsletter. With your subscription to our newsletter, we will also store your IP address and the date and time of your subscription, in addition to your e-mail address. This serves as a safeguard on our part in the event that a third party misuses your e-mail address and subscribes to our newsletter without your knowledge.
    2. In order to provide you with targeted information, we also collect and process your voluntarily provided first and last name including salutation and title.
    3. You can cancel your subscription to the newsletter at any time by pressing the "unsubscribe" button directly in the newsletter. We will then immediately delete your data in connection with the newsletter dispatch.
